Your Consent to Communications

By providing your phone number, email address, or submitting a contact form on this website, you give ReliefPlan express written consent to contact you regarding your inquiry. This consent applies regardless of whether your number appears on the National Do-Not-Call Registry.

1. What is TCPA?

The Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) is a federal law that regulates:

  • Telemarketing calls and text messages
  • Automated telephone dialing systems (autodialers)
  • Artificial or prerecorded voices
  • SMS/text messages and MMS messages
  • Fax advertisements
  • Calls to cell phones and residential lines

The TCPA requires companies to provide clear notices about communication practices and respect consumer preferences. FraudExit complies fully with TCPA requirements.

2. Types of Communications We May Send

Phone Calls

Live calls from FraudExit representatives to discuss your case, provide updates, or schedule consultations. May include callback reminders and appointment confirmations.

Automated Calls & Prerecorded Messages

We may use automated dialing systems and prerecorded messages for case updates, appointment reminders, and important notifications. These messages may be considered telemarketing under TCPA. By consenting above, you acknowledge and accept this practice.

SMS/Text Messages

Standard and automated text messages to the phone number you provide. Frequency depends on your case. Standard carrier rates apply. Reply STOP to opt out of text messages (see opt-out section).

Email

Email communications about your case, including documents, updates, and account information. Not subject to TCPA (email has different regulations) but included for transparency.

U.S. Mail

Physical mail to your address regarding your case, including notices, documents, and billing statements.

3. Message and Data Rates

Standard message and data rates from your wireless carrier apply to:

  • SMS text messages and MMS messages
  • Phone calls to mobile numbers
  • Any data used to download messages or access information

Check your wireless plan for details. FraudExit does not control carrier charges, and you are responsible for your carrier's fees. If you have unlimited calling/texting, no additional charges apply.

4. Your Right to Opt Out

You have the right to opt out of communications at any time. Multiple methods available:

Text STOP to any SMS:

Reply "STOP" to any text message from ReliefPlan. We'll honor your request within 30 days and send confirmation.

Email us:

Send "Opt-Out Request" to privacy@reliefplan.com. Include your name and email to remove.

Mail:

Send written opt-out request to ReliefPlan, Sacramento, California. Include your contact info.

Important:

Opt-out requests are processed within 30 days. However, opt-out may not stop: (1) case-related communications about your active matter, (2) billing and payment notifications, (3) responses to your inquiries, (4) communications required by law.

5. National Do-Not-Call Registry

Even if your phone number is registered on the National Do-Not-Call (DNC) Registry maintained by the Federal Trade Commission:

You are providing express written consent for FraudExit to contact you by calling, texting, and emailing regarding your inquiry and case.

This consent creates an exception to DNC regulations. FraudExit is legally permitted to contact you despite DNC registration.

If you wish to revoke this exception, you must opt out using the methods in Section 4 above.

6. Automated Calling Systems & Prerecorded Messages

FraudExit may use automated telephone dialing equipment (ATDS) and artificial or prerecorded voice messages to contact you. By providing your phone number, you consent to these technologies.

What this means: Your number may be dialed by automated systems. A recorded message may be played. You may be transferred to a live representative. These are considered telemarketing calls under TCPA.

Your rights: You can still opt out at any time (see Section 4). Automated calls are subject to the same opt-out rights as live calls.

Technical compliance: Our automated systems include: clear caller identification, obvious prerecording notification, easy disconnect option, and rapid opt-out processing.

7. Communication Privacy & Non-Privilege

Important limitations on privacy:

  • Not attorney-client privileged: Phone, text, and email communications with FraudExit are NOT protected by attorney-client privilege (we are not lawyers)
  • May be intercepted: Phone calls may be recorded by us or third parties; texts/emails may be intercepted
  • Business records: Communications become part of your case file and business records
  • Privilege with attorneys: Only communications with a licensed attorney are privileged; seek separate counsel for privileged advice

8. Frequency & Timing

Communication frequency varies based on your case:

Active cases: Multiple communications per week (calls, texts, emails) during active negotiation or regulatory process

Pending updates: Periodic check-ins (1-2x per week) while awaiting responses

Resolved cases: Follow-up communications and final documentation

We make reasonable efforts to contact during normal business hours (8 AM - 8 PM your local time), but may contact outside these hours for urgent matters.

9. Complaint & Dispute Resolution

If you believe ReliefPlan has violated TCPA regulations:

Step 1: Contact us directly

Step 2: File with FCC

If unresolved, file a complaint with the Federal Communications Commission (FCC) at fcc.gov/complaints

Step 3: FTC & Attorney General

Report to Federal Trade Commission (reportfraud.ftc.gov) or California Attorney General (ca.gov/ipp)

Step 4: Legal Action

TCPA violations may entitle you to sue for damages up to $500-$1,500 per violation. Consult an attorney for your options.
